Article 1. Seller identity
These General Terms and Conditions of Sale, hereinafter referred to as the “Terms and Conditions”, govern sales made on the Nihon-Gawa website, accessible at https://nihongawa.fr.

Article 2. Purpose and scope
These Terms and Conditions define the rights and obligations of Nihon-Gawa and its customers in connection with the online sale of products offered on the website.
They apply exclusively to orders placed by consumers, meaning natural persons acting for purposes that do not fall within the scope of their commercial, industrial, craft, professional or agricultural activity.
The customer declares that they have the legal capacity required to enter into the sales contract.
The applicable Terms and Conditions are those made available to the customer and accepted when the order is confirmed. The customer may consult, save and print them before placing an order.
Article 3. Products
The products offered may include, in particular, Japanese magazines, manga in the original Japanese version, artbooks, illustrated books, collectibles and related products.
Each product page presents, according to the information available, the essential characteristics of the product, its price, availability, condition and, where relevant, its edition, issue number, year of publication, any bonuses included and known defects.
Japanese products may contain text, instructions or information exclusively in Japanese. This characteristic is inherent to products in their original version.
The photographs are intended to present the product as faithfully as possible. Slight differences in colour may result from the screen used or the conditions under which the photographs were taken. However, such differences cannot relate to an advertised essential characteristic of the product.
For second-hand or collectible items, signs of use, age-related marks, minor alterations, printing variations or other particularities may be present. Known and significant defects are indicated on the product page or visible in the photographs. Defects expressly brought to the customer’s attention before the order may not subsequently be invoked as a lack of conformity in respect of that same characteristic.
Article 4. Prices
Prices are stated in euros.
As Nihon-Gawa operates under the basic VAT exemption scheme, prices are stated net of VAT in accordance with Article 293 B of the French General Tax Code.
Delivery charges are not included in the price of the products unless otherwise indicated. Their amount is calculated according to the order, its destination and the delivery method selected, then displayed before final confirmation of payment.
The total price payable by the customer, including the price of the products and applicable charges, is presented before the order is confirmed.
Prices may be changed at any time, without affecting orders that have already been confirmed. The product is invoiced at the price displayed when the order is confirmed.
In the event of an obvious pricing error making the price negligible in relation to the actual value of the product, Nihon-Gawa informs the customer as soon as possible. The customer may then confirm the order at the correct price or have it cancelled and receive a full refund of the amounts paid.
Discounts, promotions or clearance operations do not remove any statutory consumer right. They do not, in themselves, constitute an exclusion of the right of withdrawal.
Article 5. Ordering process
The customer selects the products they wish to purchase, adds them to their basket and then provides the information required to process and deliver the order.
Before final confirmation, the customer can check the details of the order, its total price and the information provided, and correct any errors.
Confirmation using the button that clearly indicates that the order entails an obligation to pay constitutes acceptance of the order and of these Terms and Conditions.
A confirmation summarising, in particular, the products ordered, the price paid, the delivery address and these Terms and Conditions is sent to the customer electronically on a durable medium.
The customer must provide accurate, complete and up-to-date information. In particular, the customer is responsible for checking their name, postal address, email address, telephone number and, where applicable, the selected Point Relais or Locker.
Nihon-Gawa may refuse or cancel an order for a legitimate reason, particularly in the event of a refused payment, reasonable suspicion of fraud, clearly incorrect information, product unavailability or a previous dispute concerning payment for an order. The customer is informed and the amounts collected for the cancelled order are refunded.
Article 6. Payment
The available payment methods are those displayed during checkout. They may include bank card, Shop Pay, Apple Pay, PayPal and, when offered, Klarna.
Payment is due when the order is confirmed, except where a different arrangement is expressly offered by a payment provider. In that case, the provider’s specific terms are communicated to the customer before they commit.
The order is considered paid only after actual confirmation of payment by the relevant provider.
Nihon-Gawa retains ownership of the products until the price has been paid in full. This retention of title does not alter the transfer of risk provided for in Article 9.
Article 7. Product availability
Products are offered subject to available stock.
When a quantity is displayed as available, it corresponds to the stock recorded by the shop at the time of consultation. A stock error or simultaneous orders may exceptionally make a product unavailable after the order has been confirmed.
In this case, the customer is informed as soon as possible. Nihon-Gawa refunds the amounts corresponding to the unavailable product, together with any delivery charges attributable solely to that product, without undue delay.
In an order containing several products, the unavailability of one item does not automatically result in the cancellation of the other available products. The customer is informed when a decision regarding the remainder of the order is necessary.
Article 8. Pre-orders and monthly boxes
Certain products may be offered for pre-order before they are physically available from Nihon-Gawa.
The product page clearly states its pre-order status, the known Japanese release date and the estimated dispatch or delivery date or period communicated to the customer before purchase.
This period takes into account receipt of the product from the supplier located in Japan, its international shipment and then its preparation in France.
Release, supply and transport dates may be changed by the publisher, supplier or carrier. When a change affects the announced delivery date or period, the customer is informed as soon as possible.
Monthly boxes containing several magazines are dispatched once Nihon-Gawa has received all the magazines making up the box. Their exact contents and estimated dispatch period are indicated on the product page.
Unless expressly stated otherwise, a monthly box sold on a one-off basis constitutes a one-time purchase. It is not a subscription and is not subject to automatic renewal.
If a pre-ordered product ultimately cannot be obtained, Nihon-Gawa may cancel the product concerned and refund the corresponding amounts in full.
If one of the magazines required to make up a box cannot be obtained, Nihon-Gawa may cancel the entire box and refund the corresponding amounts in full.
These provisions do not limit the customer’s rights if the announced delivery date or period is exceeded.
Article 9. Delivery
Nihon-Gawa currently delivers to mainland France, as well as Germany, Belgium, Spain, Italy, Luxembourg, Portugal and Morocco.
Orders are dispatched from France. The delivery methods offered depend in particular on the destination country, address, postal code, order weight and parcel characteristics. Only options that are actually available and displayed to the customer during checkout may be selected.
In mainland France, orders may in particular be dispatched by:
- Mondial Relay, to a Point Relais® or Locker, subject to availability;
- Chronopost / Chrono 2Shop, to a collection point, subject to availability;
- Colissimo (La Poste), to a collection point or home address;
- Chronopost, to a home address, depending on the services offered during checkout.
For the other countries served, orders are generally dispatched by Mondial Relay or Chronopost / Chrono 2Shop, depending on the services available for the destination concerned.
Orders consisting solely of in-stock items are generally prepared within 1 to 2 business days after payment is confirmed. Orders placed during a weekend, public holiday or outside dispatch periods begin to be processed on the next business day.
From the time the parcel is handed over to the carrier, the usual transit times for delivery in mainland France are in particular approximately:
- 2 business days for Colissimo;
- 3 to 5 business days for Mondial Relay.
The times applicable to other delivery services, including Chronopost, and to international deliveries may vary depending on the service selected and the destination country.
In all cases, the delivery date or period actually applicable to the order is the one communicated to the customer before the purchase is confirmed. Where applicable, these times are added to the order preparation time.
In the absence of an expressly agreed date or period, the order is delivered without undue delay and no later than thirty days after the contract is concluded.
When an order contains both in-stock items and one or more pre-ordered products, it is dispatched as a single parcel once all products are available, unless otherwise indicated on the website or specifically agreed with the customer. In-stock items may therefore wait until the pre-ordered products become available.
The customer may request separate dispatch. This remains subject to Nihon-Gawa’s prior agreement and may require payment of the corresponding additional delivery charges.
For delivery to a Point Relais®, collection point or Locker, the customer must collect the parcel within the period communicated by the carrier. The selected point may be replaced by another available point in the event of closure, saturation or unavailability.
The automatic return of an uncollected parcel does not, by itself, constitute exercise of the right of withdrawal. The customer must contact Nihon-Gawa to indicate how they wish to proceed with the order.
When the parcel is returned because it was not collected or because the customer provided incorrect information, the actual cost of a new dispatch may be charged to the customer. No reshipping charges are requested when the return results from an error by Nihon-Gawa or the carrier.
For orders dispatched to a country outside the European Union, including Morocco, customs duties, import taxes or other charges may be imposed by the authorities of the destination country.
Unless otherwise indicated to the customer during checkout, any such duties, taxes and charges are not included in the price of the products or in the delivery charges invoiced by Nihon-Gawa and remain the responsibility of the recipient. The customer is advised to contact the relevant authorities in their country regarding any formalities and charges that may apply.
In the event of a delay in relation to the announced date or period, the customer may ask Nihon-Gawa in writing to complete delivery within a reasonable additional period. If delivery does not take place within this period, the customer may terminate the contract under the conditions provided for by the French Consumer Code. The customer may terminate it immediately if Nihon-Gawa refuses to deliver, if it is clear that delivery will not take place, or if the delivery date constituted an essential condition of the contract that was indicated before the order.
If the contract is validly terminated for failure to deliver, the amounts paid are refunded no later than fourteen days after notification of termination.
The risk of loss or damage passes to the customer when they take physical possession of the product, or when a third party designated by them takes possession of it. When the customer, on their own initiative, chooses a carrier that was not offered by Nihon-Gawa, the risk passes when the product is handed over to that carrier.
If the parcel arrives visibly damaged, the customer is advised, where possible, to refuse delivery or make specific reservations with the carrier, then promptly contact Nihon-Gawa. The absence of reservations does not remove the customer’s rights under the statutory guarantees.
If the tracking information shows that the parcel has been delivered when it has not been received, the customer must contact Nihon-Gawa so that an investigation can be opened with the carrier.
Article 10. Cancellation before dispatch
For products that are not excluded from the right of withdrawal, the customer may request cancellation of the order before it is dispatched, in particular using the features available in their customer account, where available.
Nihon-Gawa processes the request where possible, but cancellation can no longer be guaranteed once preparation or dispatch has begun. This does not limit the statutory right of withdrawal where it remains applicable.
Magazines sold by pre-order and one-off boxes made up exclusively of magazines constitute final purchases as soon as payment is confirmed. They cannot be cancelled simply because the customer changes their mind, without prejudice to the customer’s rights in the event of unavailability, failure to deliver, lack of conformity or application of a statutory guarantee.
Article 11. Right of withdrawal
Subject to the exceptions set out in Article 12, the consumer has a period of fourteen calendar days to exercise their right of withdrawal without having to give a reason for their decision.
For the sale of goods, this period begins on the day after the day on which the customer, or a third party other than the carrier and designated by the customer, takes physical possession of the goods.
For an order concerning several goods delivered separately, or goods consisting of several lots or parts delivered in stages, the period runs from receipt of the last item, lot or part.
For a contract providing for the regular delivery of goods over a defined period, the period runs from receipt of the first item.
If the period expires on a Saturday, Sunday, public holiday or non-working day, it is extended until the next business day.
The customer may exercise this right before the period expires:

using the electronic withdrawal feature available from their customer account or the order status page;
-
by sending the standard form appended to these Terms and Conditions;

or by any other unambiguous written statement expressing their wish to withdraw, sent to nihongawainfo@gmail.com or to Nihon-Gawa’s postal address.
When the electronic feature is used, an acknowledgement of receipt containing the statement as well as the date and time it was sent is provided to the customer on a durable medium.
Simply returning the product, refusing the parcel or failing to collect it from a Point Relais or Locker is not sufficient to validly express the wish to withdraw.
Article 12. Exceptions to the right of withdrawal
In accordance with Article L. 221-28 of the French Consumer Code, the statutory right of withdrawal does not apply in particular:

to goods made to the consumer’s specifications or clearly personalised;
-
to the supply of newspapers, periodicals or magazines, except under a subscription contract for such publications.
Consequently, the statutory right of withdrawal cannot be exercised for magazines sold by pre-order or for one-off boxes made up exclusively of magazines.
As a commercial gesture, Nihon-Gawa nevertheless grants a contractual fourteen-day right of return for magazines sold as immediately available in-stock items, under the same conditions as those set out in Articles 11 to 14, unless the product page clearly indicates before the order that the item constitutes a final sale falling within the statutory exception.
In an order containing both a product excluded from the right of withdrawal and other eligible products, the exclusion applies only to the product concerned. The other products retain their right of withdrawal.
These exclusions never limit the customer’s rights when the product is damaged, defective, non-conforming, sent in error or not delivered.
Article 13. Return arrangements
After communicating their decision to withdraw, the customer must return the product without undue delay and no later than fourteen days after that communication to the following address:

The direct cost of return in connection with a withdrawal is borne by the customer. This rule does not apply to returns resulting from an error by Nihon-Gawa, a lack of conformity or the implementation of a statutory guarantee.
The customer is advised to choose a dispatch method suited to the nature and value of the product and to retain proof of dispatch. Nihon-Gawa cannot require the use of a particular carrier to exercise the right of withdrawal.
The product must be returned with its accessories, components and bonuses when they form part of the product sold. The customer is responsible for any depreciation resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the product.
Article 14. Refund following withdrawal
When the right of withdrawal is validly exercised, Nihon-Gawa refunds the amounts due, including the initial standard delivery charges, without undue delay and no later than fourteen days after the date on which it is informed of the customer’s decision.
Nihon-Gawa may defer the refund until the returned products are recovered or until proof of their dispatch is received, whichever occurs first.
Additional costs resulting from the customer’s choice of a delivery method more expensive than the standard delivery method offered are not refunded.
The refund is made using the same payment method as that used for the initial transaction, unless the customer expressly agrees to another method that does not incur any costs for them.
Article 15. Damaged products, errors and complaints
The customer is advised to check the condition and contents of the order upon receipt.
In the event of a damaged, defective, incomplete, non-conforming product or a product different from the one ordered, the customer may contact Nihon-Gawa at nihongawainfo@gmail.com.
To facilitate processing of the request, Nihon-Gawa may request the order number, photographs of the product and its packaging, or any other item reasonably necessary to examine the situation.
This procedure neither limits nor makes conditional the customer’s rights under the statutory guarantees.
Article 16. Statutory guarantees
New and second-hand products sold by Nihon-Gawa benefit from the statutory guarantee of conformity and the statutory guarantee against hidden defects under the conditions provided for by law.

Notice concerning statutory guarantees
The consumer has a period of two years from delivery of the goods to obtain implementation of the statutory guarantee of conformity in the event that a lack of conformity appears. During this period, the consumer is required to establish only the existence of the lack of conformity and not the date on which it appeared.
Where the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the statutory guarantee applies to that digital content or digital service throughout the scheduled supply period. During this period, the consumer is required to establish only the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
Where applicable, the statutory guarantee of conformity requires the trader to provide all updates necessary to maintain the conformity of the goods.
The statutory guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller requires replacement, the statutory guarantee of conformity is renewed for a period of two years from the date on which the goods are replaced.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and receive a full refund in exchange for returning the goods, if:
1° The trader refuses to repair or replace the goods;
2° The goods are repaired or replaced after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer definitively bears the cost of taking back or removing the non-conforming goods, or where they bear the installation costs of the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request repair or replacement of the goods beforehand.
The consumer is not entitled to termination of the sale if the lack of conformity is minor.
Any period during which the goods are unavailable for the purpose of repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.
The rights referred to above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who, in bad faith, obstructs implementation of the statutory guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to up to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the statutory guarantee against hidden defects pursuant to Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are retained, or a full refund in exchange for returning the goods.
Unless expressly stated on the product page, Nihon-Gawa does not offer any additional commercial guarantee. The absence of a commercial guarantee does not affect the statutory guarantees.
Article 17. Liability and force majeure
Nihon-Gawa is responsible for proper performance of the obligations arising from the contract in accordance with applicable legislation.
However, Nihon-Gawa cannot be held liable for damage resulting from misuse of the product, fault on the part of the customer or an event of force majeure displaying the characteristics recognised by French law and case law.
No provision of these Terms and Conditions may have the effect of limiting or excluding any liability or right whose limitation or exclusion is prohibited by law.
Article 18. Intellectual property
Original texts, original photographs, graphics, the logo, visual identity and other elements created specifically for Nihon-Gawa are protected by the applicable intellectual property rules.
Any unauthorised reproduction, representation, modification, adaptation or exploitation of these elements is prohibited, subject to the exceptions provided for by law.
Trademarks, series names, characters, logos, illustrations, covers, works and other elements belonging to third-party publishers, authors, manufacturers, studios or rights holders remain the property of their respective owners.
Unless expressly stated, Nihon-Gawa is neither affiliated with, sponsored by, nor endorsed by the publishers, authors or rights holders represented by the products sold.
Article 19. Personal data and telephone
Personal data collected when an order is placed is processed in accordance with applicable regulations.
Information concerning the purposes of processing, recipients, retention periods and the rights of data subjects is set out in Nihon-Gawa’s Privacy Policy.
In accordance with Article L. 223-2 of the French Consumer Code, telephone marketing to a consumer without their prior consent is prohibited, except in cases expressly authorised by law, particularly when the communication takes place in connection with performance of an ongoing contract and relates to its subject matter.
The telephone number provided when the order is placed is used primarily for the performance and tracking of the order, particularly when it must be communicated to the carrier for delivery purposes.
Article 20. Evidence and archiving of the contract
Computerised records kept under reasonably secure conditions by Nihon-Gawa and its service providers may constitute evidence of communications, orders and payments, without depriving the customer of the opportunity to provide evidence to the contrary.
When a contract concluded electronically concerns an amount equal to or greater than 120 euros, Nihon-Gawa retains it for the statutory period. Where delivery is immediate, the contract is retained for ten years from the date it is concluded. In other cases, it is retained until delivery and then for ten years from that date.
The customer may request access to the archived contract by writing to nihongawainfo@gmail.com and providing the information needed to identify the order concerned.
Article 21. Extended producer responsibility
Nihon-Gawa comes under the extended producer responsibility scheme for household packaging and graphic paper (EMPAP) and has chosen Citeo as its producer responsibility organisation.

Article 22. Consumer mediation
In the event of a dispute, the customer must first send a written complaint to Nihon-Gawa at nihongawainfo@gmail.com or to the postal address indicated in Article 1, in an attempt to reach an amicable solution.
If this complaint remains unanswered or without a satisfactory solution, the consumer may, free of charge, under the conditions provided for by the French Consumer Code and within one year of their written complaint, refer the matter to the consumer mediator to which Nihon-Gawa belongs:

Recourse to mediation does not deprive the consumer of the right to bring proceedings before a court with jurisdiction.
Article 23. Applicable law and dispute resolution
These Terms and Conditions and the contracts concluded on the website are governed by French law.
This provision does not deprive a consumer residing in another State of the mandatory protective provisions from which no derogation is permitted under the applicable legislation.
In the event of a dispute, the parties are invited first to seek an amicable solution and then, where applicable, to use the mediation procedure provided for in Article 22.
Failing amicable resolution or mediation, the courts with jurisdiction are determined in accordance with the applicable legal rules. No provision of these Terms and Conditions requires the consumer to submit to a court contrary to the protective rules applicable to them.
Article 24. Amendment and severability of the Terms and Conditions
Nihon-Gawa may amend these Terms and Conditions, in particular to take account of changes in legislation, regulations, technology or its services.
The Terms and Conditions enforceable against an order remain those accepted by the customer when it was confirmed. A subsequent amendment does not apply retroactively to orders already concluded.
If any provision of these Terms and Conditions is declared void, unlawful or unenforceable, the other provisions remain applicable to the extent permitted by law.
